A new redevelopment agreement for the second phase of The Brownstones development could come up for approval as early as next month.

During his report to commissioners at the Redevelopment Agency’s monthly meeting on Wednesday, Executive Director Robert Landolfi said they’re working with the developer of the Elizabeth Avenue project to amend the redevelopment agreement for the second phase. “They’ve indicated they’re committed to completing phase two but will require we amend that agreement,” he said.
Landolfi anticipates commissioners could have an amended redevelopment agreement to vote on at the agency’s next meeting, scheduled for Nov. 4. UPDATED, 10/31: The Nov. 4 meeting has been canceled and likely will be rescheduled for Nov. 18, Landolfi said in a telephone interview on Friday.
Redevelopment Agency General Counsel Anne Rowan confirmed that an amended redevelopment agreement is on track to be presented at the November meeting. The developer is finalizing the project schedule and hitting all the milestones, she said.
Linden-based Capodagli Property Company is completing phase one on 172 units at the corner of West Grand and Elizabeth avenues. In June, Landolfi told commissioners that Capodagli will not proceed to phase two and instead would undertake a study to determine what phase two should be, including possible alternative uses for the property.
The original 55-page redevelopment agreement was approved by the Redevelopment Agency in 2013. Among other provisions, the redevelopment agreement stipulates that the last phase be completed within five years of acquisition — which was 2015 — although the original timeline also was pushed back. Phase one didn’t break ground until 2018.
In her report to commissioners, Engineer Jacqueline Dirmann said construction at The Brownstones is ongoing, with streetscape along Elizabeth and West Grand avenues. Internal drainage and sanitary sewer work have been completed and a temporary certificate of occupancy (TCO) request is anticipated in December, she said.
Nov. 18 UPDATE: Capodagli requested a temporary certificate of occupancy (TCO) for 171 unit for phase 1a of The Brownstones, Dirmann reported at the Nov. 18 Redevelopment Agency meeting. Phase 1 includes 298 apartments.
The Brownstones replaced the long-vacant Wheatena factory and received Planning Board approval in 2014. At the time, it was planned as multi-phase project that ultimately would comprise 487 units for lease and 541 parking spaces within four, five-story buildings on the 6.5-acre site.
